Welcome to ProntoSIM (the "App"), developed by SwiftyByte SARL. These Terms and Conditions ("Terms") govern your use of the App. By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please discontinue your use of the App. We reserve the right to update or modify these Terms at any time, and continued use of the App indicates acceptance of such changes.
2. Definitions
- eSIM: An embedded SIM card provided via the App for mobile connectivity. - User: Any person or entity using the App. - Service: All services provided via the App, including eSIM activation, data plan management, and support.
3. Eligibility
The App is intended for use by individuals aged 18 or older. By using the App, you confirm that you meet this eligibility requirement.
4. Account Registration
To access certain features, you may be required to create an account. You are responsible for keeping your login details secure and for all activities that occur under your account.
5. eSIM Services
- Activation and Usage: The App allows you to purchase, activate, and manage eSIMs for your devices. - Network Coverage: The availability and quality of network services are dependent on third-party providers and are beyond our control. - Data Plans: You are responsible for managing your data usage according to your selected plan.
6. Fees and Payments
- Pricing: Prices for eSIMs and related services will be provided within the App. Prices are subject to change at any time. - Payment: You must use a valid payment method to purchase services through the App. By completing a transaction, you authorize us to charge your selected payment method for the total amount. - Refund Policy: All sales are final. Refunds may be granted at our discretion under specific circumstances. However, once an eSIM has been installed, activated, or consumed (in whole or in part), it is strictly non-refundable under any circumstances. This includes, but is not
limited to, cases of user error, device incompatibility, or dissatisfaction with network performance provided by third parties. By proceeding with an eSIM installation or activation, you acknowledge and accept that you waive any right to a refund.
7. License to Use the App
We grant you a limited, non-transferable, and revocable license to use the App for personal purposes. You are prohibited from:
- Reproducing, distributing, or modifying any part of the App. - Using the App for unlawful activities or purposes. - Attempting to reverse-engineer or extract the source code of the App.
8. User Responsibilities
By using the App, you agree to:
- Abide by all applicable laws and regulations. - Provide accurate and truthful information when creating an account and during use of the App. - Avoid transmitting harmful content, such as viruses or malware, through the App.
9. Data Privacy
Your personal data will be handled in accordance with our Privacy Policy. We take reasonable steps to secure your data, but we cannot guarantee absolute security.
10. Intellectual Property
All trademarks, logos, and content associated with the App are owned by SwiftyByte SARL or its licensors. You are granted no rights to use our intellectual property beyond what is expressly permitted in these Terms.
11. Limitation of Liability
We are not liable for any indirect, incidental, special, or consequential damages arising from your use or inability to use the App. We do not guarantee continuous, error-free access to the App or any specific service availability.
12. Indemnification
You agree to indemnify and hold SwiftyByte SARL, its officers, employees, and partners harmless from any claims, losses, liabilities, or expenses arising from your use of the App or your violation of these Terms.
13. Termination of Access
SwiftyByte SARL reserves the right, at its sole discretion, to suspend, restrict, or terminate your access to the App or Service at any time without notice if you violate these Terms,
engage in prohibited activities, or pose a risk to the security, integrity, or functionality of the Service.
14. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of Lebanon. Any disputes arising in connection with these Terms will be resolved through binding arbitration in Lebanon. You waive the right to pursue legal action in a court of law.
15. Modification of Terms
SwiftyByte SARL reserves the right to modify or update these Terms at any time. You will be notified of significant changes via the App or email. Continued use of the App following such changes constitutes acceptance.
16. Third-Party Providers
The eSIM services are provided by third-party network operators. SwiftyByte SARL does not control these providers and is not liable for any acts, errors, or failures on their part.
17. Data Security
While we take reasonable steps to protect your data, we cannot guarantee complete security. You acknowledge and accept the inherent risks of transmitting data online and agree that we are not liable for unauthorized access, data loss, or breaches.
